REFERENDUM
A referendum is a tool under state law that gives citizens 30 days after an ordinance is ratified to collect signatures from registered voters in that city to force the law to either be rescinded by the city council or placed before the voters. By qualifying a refrendum, both ordinances will be placed on hold.
If Santa Ana City Council does not change their vote, CAA is prepared to challenge the ordinances by referendum. CAA has conducted a thorough legal analysis and our attorneys have determined that lawsuits will not stop these two laws from going into effect. The only option to halt these laws is to take them to the voters through the referendum process.
The California Apartment Association (CAA) is leading the effort to collect 17,500 signatures from Santa Ana registered voters starting October 6, 2021. If successful, the ordinances will be suspended from taking effect and the city council can either rescind the law or allow the voters to weigh in on whether the policy is right for Santa Ana. It is critical that we stop this ordinance from taking effect and keep these policies from spreading to other Orange County and Southern California cities.
CAA successfully used the referendum process to halt four rent control ordinances in California-Richmond (2015), Santa Rosa (2016), Pacifica (2017), and El Cerrito (2018). The same team of consultants, pollsters, attorneys, and community organizers who achieved winning results in these cities has been retained for Santa Ana.
